Standard Licensing Agreement
This document outlines the terms and conditions for the use and ownership of media (photography, videography, and other content) provided by Tour Shots (referred to as the “Creator”). By accepting delivery of the media, the client (referred to as the “Client”) agrees to the following terms.
License Types
We offer two types of licenses depending on your needs:
Copyright & Ownership
All media created by the Creator is protected by copyright laws. Ownership of the media remains with the Creator unless explicitly transferred through a written agreement. The Client is granted a license to use the media, not ownership of the copyright.
Under the Standard License, you may use the media for:
- Online Listings Posting on Multiple Listing Service (MLS), use on personal or brokerage websites.
- Print Marketing Inclusion in brochures, flyers, and postcards for the specific property or project.
- Social Media Sharing on professional accounts to promote the active listing or project.
- Video Tours Use of video footage in virtual tours or promotional videos for the listed property.
Unless an Unlimited Use License is purchased:
- No Unauthorized Distribution You may not give, sell, or license the photos to stagers, builders, or other agents without permission.
- No Reuse For Other Projects Media may not be used for general branding ads unrelated to the specific property/project.
- No Alterations You may not apply heavy filters or edit the media in a way that misrepresents the property.
- No Copyright Transfer Payment covers the license to use, not the purchase of the copyright itself.
Fees and Payment
The Client agrees to pay all fees as agreed upon before the delivery of the media. If the Client requires the “Unlimited Use License,” this must be requested and paid for as an additional line item.
Liability and Indemnification
The Creator is not liable for any misuse of the media by the Client or third parties. The Client agrees to indemnify and hold the Creator harmless from any claims arising from their use of the media.
Termination & Governing Law
Termination: The Creator reserves the right to revoke the license if the Client breaches any terms of this agreement.
Governing Law: This agreement is governed by the laws of British Columbia, Canada.
Acknowledgement: By accepting delivery of the media, the Client acknowledges that they understand and agree to these terms.
