Standard Licensing Agreement for Real Estate Media

This document outlines the terms and conditions for the use and ownership of media (photography, videography, and other content) provided by Tour Shots (referred to as the “Creator”). By accepting delivery of the media, the client (referred to as the “Client”) agrees to the following terms:

Copyright and Ownership

All media created by the Creator is protected by copyright laws, granting the Creator exclusive rights to reproduce, distribute, and display the content. Ownership of the media remains with the Creator unless explicitly transferred through a written agreement.
The Client is granted a license to use the media, not ownership. This license allows the Client to use the media solely for the agreed-upon purposes outlined in this document.

Permitted Uses

The Client may use the media for the following purposes, as applicable to real estate marketing:

Online Listings
Posting on Multiple Listing Service (MLS).
Use on personal or brokerage websites.
Uploading to third-party real estate platforms.
Print Marketing
Inclusion in brochures, flyers, postcards, and other printed materials for marketing the specific property.
Social Media
Sharing photos or videos on personal or professional social media accounts to promote the property.
Video Tours and Virtual Showings
Use of video footage in virtual tours, walk-throughs, or promotional videos for the listed property.
Other Approved Uses
Any additional uses explicitly agreed upon in writing between the Creator and the Client.

Restrictions

The Client agrees to the following restrictions:
No Unauthorized Distribution
The media may not be shared, sold, or sublicensed to third parties (e.g., other agents, brokers, property owners, or unrelated businesses) without the Creator’s prior written consent.
No Reuse for Other Projects
The media may not be used for properties or projects other than the one specified at the time of the agreement without prior permission.
No Misrepresentation
The Client may not edit or alter the media in a way that misrepresents the property or damages the Creator’s reputation.
No Copyright Infringement
Unauthorized use, reproduction, or distribution of the media constitutes copyright infringement and may result in legal action.

Exclusive Rights

If the Client requires exclusive rights to the media, they must request this in writing. The Creator will generally grant exclusive rights for an additional fee or under specific conditions.

Term of License

The license is valid for the duration of the property listing or as otherwise specified in writing. Once the property is sold, rented, or removed from the market, the Client’s right to use the media expires unless renewed or extended through a new agreement.

Fees and Payment

The Client agrees to pay all fees as agreed upon before the delivery of the media. Payment for the media is for the license to use, not for ownership, unless explicitly agreed otherwise.

Liability and Indemnification

The Creator is not liable for any misuse of the media by the Client or third parties. The Client agrees to indemnify and hold the Creator harmless from any claims arising from their use of the media.

Termination

The Creator reserves the right to revoke the license if the Client breaches any terms of this agreement.

Governing Law

This agreement is governed by the laws of British Columbia, Canada.

Acknowledgment

By accepting delivery of the media, the Client acknowledges they understand and agree to these terms.
